1. Who we are

JMG Coaching is a career coaching business operated by Jose Miranda Garcia as a sole trader, based in Sydney, New South Wales, Australia. ABN 33 459 235 435.

In this policy, “we”, “us” and “our” mean JMG Coaching. “You” means anyone who visits our website, completes our assessment, subscribes to our emails, or becomes a client.

We take your privacy seriously. This policy explains what personal information we collect, why we collect it, who we share it with, and what you can do about it. It is written to align with the Australian Privacy Act 1988 and the Australian Privacy Principles.

2. What we collect

When you complete the Career Alignment Audit or any form on our site:

  • Your first name and last name
  • Your email address
  • Your phone number
  • Your answers to the assessment questions
  • Whether you consented to receive SMS messages

When you buy something from us:

  • Your billing details and the record of your purchase
  • We do not see or store your full card number. Payments are handled by Stripe, and your card details go directly to them.

When you become a coaching client:

  • Notes from our sessions, the goals you set, and anything you choose to share with us during the coaching relationship
  • Any documents you send us, such as a résumé

Automatically, when you visit our website:

  • Your IP address, browser type and device
  • Which pages you visited and how long you stayed
  • How you arrived at our site — for example, from a Facebook ad or a search result

3. How we collect it

Almost always, directly from you: you type it into a form, you tell us on a call, or you send it to us by email.

Some information is collected automatically by cookies and tracking pixels while you browse. Section 7 covers that.

Occasionally someone may refer you to us and pass on your name and contact details. If that happens, we will tell you who referred you the first time we contact you.

You can interact with our website without giving us your name. If you would rather deal with us anonymously or under a pseudonym, tell us — though we may not be able to deliver coaching services without knowing who you are.

4. Why we collect it

We use your personal information to:

  • Score your assessment and send you your result
  • Give you access to the masterclass, courses and materials you signed up for
  • Deliver coaching services you have purchased
  • Send you emails about our services, offers and content
  • Send you SMS messages, if you consented to that
  • Process your payments and keep the records the ATO requires
  • Answer your questions and provide support
  • Improve our website, our assessment and our services
  • Meet our legal obligations

We do not sell your personal information. We do not trade it, rent it, or hand it to data brokers.

5. Who we share it with

We share your information with the following service providers, only so far as they need it to do their job:

  • GoHighLevel — our CRM. Stores your contact details, assessment answers, our email and SMS history with you, and your course access. Data held in the United States.
  • Stripe — processes payments and handles your card details directly. Data held in the United States and other countries.
  • Meta (Facebook and Instagram) — advertising. Our website carries a Meta pixel that reports website activity back to Meta. Data held in the United States.
  • Google — website analytics, if enabled. Data held in the United States and other countries.

Your information is stored and processed overseas. GoHighLevel, Stripe and Meta are all based in the United States, which means your personal information leaves Australia. Australian privacy law may not apply to how those companies handle it, and you may not be able to seek redress under Australian law against them. Each of them publishes its own privacy policy, and we choose providers that maintain recognised security standards.

We may also disclose your information if the law requires it, or if we need to in order to protect someone’s safety or enforce our terms.

6. Marketing emails and SMS, and how to stop them

Email. If you complete our assessment, download something from us, or buy from us, we will send you marketing emails as well as the material you asked for. Every marketing email has an unsubscribe link at the bottom. Click it and you are off the list. You can also email us at [email protected] and ask.

SMS. We only send marketing SMS to people who ticked the consent box. Reply STOP to any message and we will stop. Reply HELP for assistance. Standard message and data rates from your carrier may apply.

A note on the difference. Even after you unsubscribe from marketing, we may still send you messages that are necessary to deliver something you paid for — course login details, session reminders, receipts. Those are not marketing and you cannot unsubscribe from them while you hold an active purchase.

Unsubscribing takes effect as soon as we process it, usually immediately and at most within five business days.

7. Cookies and tracking

Our website uses cookies — small files stored on your device — and tracking pixels.

What they are for:

  • Essential cookies make the site work: keeping you logged in, remembering your progress through the assessment.
  • Analytics cookies tell us which pages people visit and where they drop off, so we can improve the site.
  • The Meta pixel tells Facebook and Instagram which of our pages you visited. We use it to measure whether our ads work and to show ads to people who have visited our site. It also lets Meta build audiences of people similar to our visitors.

How to control them. Every major browser lets you block or delete cookies in its settings. Blocking essential cookies may break parts of our site. You can also control ad targeting inside your Facebook and Instagram settings, under Ad Preferences.

8. How we store and protect it

Your information lives in GoHighLevel and Stripe, both of which encrypt data in transit and at rest and maintain industry-standard security. Access to our accounts is limited to Jose Miranda Garcia and, where necessary for technical work, our contracted technical support provider — who may access systems only to build and maintain them, not to use your data for any other purpose.

We protect our accounts with strong, unique passwords and two-factor authentication where available.

No system is perfectly secure. We cannot guarantee that information sent over the internet is completely safe, and we accept no responsibility for events genuinely outside our control. If a data breach occurs that is likely to cause you serious harm, we will notify you and, where the law requires it, the Office of the Australian Information Commissioner.

9. How long we keep it

  • If you never become a client: we keep your contact details and assessment result while you remain subscribed, and for up to two years after you unsubscribe or last engage with us.
  • If you become a client: we keep your records for seven years after our engagement ends, which is what Australian tax and business record-keeping rules require.
  • Coaching session notes: kept for the duration of the engagement plus seven years, then deleted.

When we no longer need your information and no law requires us to keep it, we delete it or de-identify it.

10. Getting a copy, correcting it, or having it deleted

You can ask us at any time to:

  • Send you a copy of the personal information we hold about you
  • Correct anything that is wrong or out of date
  • Delete your information

Email [email protected] with what you want. We may ask you to confirm your identity first — we are not going to hand your data to someone claiming to be you.

We will respond within 30 days. There is no charge for a reasonable request.

If we cannot delete something — for example, transaction records we are legally required to keep for seven years — we will tell you what we are keeping and why.

11. If you have a complaint

Email [email protected] with “Privacy complaint” in the subject line and tell us what happened. We will acknowledge it within five business days and give you a written response within 30 days.

If you are not satisfied with how we handle it, you can take it to the Office of the Australian Information Commissioner:

12. Children

Our services are for working adults and are not directed at anyone under 18. We do not knowingly collect personal information from children. If you believe a child has given us their information, email us and we will delete it.

13. Changes to this policy

We may update this policy as our business changes. The current version always lives at this page, with the date it was last updated at the top. If we make a change that materially affects how we handle your information, we will tell subscribers by email.
